Welcome to Elox Digital. These Terms of Use ("Terms") govern your access to and use of the website located at https://elox.digital, as well as the purchase of our products and the licensing of our digital services (including development services, security audits, automation systems, and algorithmic trading tools).
By browsing the site, placing an order, or utilizing our services, you agree to be bound by these Terms in their entirety. If you do not agree, you must immediately discontinue using our services.
1. Service Description & License Grants
Elox Digital provides technology solutions, custom software development, digital system auditing, email and SMS automation (Elox Mail), and copy trading software. Our core product portfolio includes:
- Elox Farma: Pharmacy and drugstore automation and management system.
- Elox SNGPC & Elox Farma + SNGPC: Integrations, validation, and automated transmitters of SNGPC files for pharmacies.
- Elox Trader: High-frequency trading robots and automated algorithmic solutions for investors.
- Elox COPY NT8: Local and remote order copier for the NinjaTrader 8 platform.
- Elox Mail (Lite, Starter, Standard, Professional, Enterprise): Marketing automation, bulk email, and SMS dispatch platforms.
- Custom Services: Custom Website Creation (Site Institucional) and Specialized Consulting & Audits (Consultoria).
Software Licensing: Licenses purchased from Elox Digital are non-exclusive, non-transferable, revocable, and limited to use according to the plan terms selected during purchase. Refactoring, reverse-engineering, or subleasing our software without explicit written consent is strictly prohibited.
2. Acceptable Use of Elox Mail (Marketing Automation)
You agree to utilize our communications infrastructure, including all Elox Mail plans (Lite, Starter, Standard, Professional, Enterprise), in compliance with applicable anti-spam laws. Specifically, you agree:
- Not to send unsolicited bulk commercial messages (SPAM).
- To import only contact lists containing recipients who have explicitly consented (opt-in) to receive your communications.
- Not to distribute content that is illegal, defamatory, abusive, or designed to commit phishing, fraud, or spread malware.
We reserve the right to suspend or terminate Elox Mail services immediately, without refund, if we detect practices that violate these usage guidelines or damage our servers' IP reputation.
3. Financial and Trading Risk Disclaimer
Trading in financial markets involves high risk, and you may lose all or a portion of your capital. By using Elox Trader or Elox COPY NT8, you acknowledge and agree that:
- You are solely responsible for setting up, configuring, and monitoring the parameters of the software.
- Elox Digital is not liable for financial losses, slippage, connectivity drops, platform changes, API modifications, or trade execution errors caused by third-party brokerages or trading platforms (such as NinjaTrader 8 or cTrader).
- Past performance results simulated or indicated by software configurations do not guarantee future performance.
4. Healthcare & Regulatory Files Disclaimer (Elox SNGPC)
Regarding Elox SNGPC and Elox Farma + SNGPC tools:
- You are solely responsible for verifying the accuracy of the pharmacological data and files generated before submitting them to health regulatory systems (such as ANVISA's SNGPC).
- Elox Digital provides the technical framework for transmission and validation, but is not liable for regulatory fines, audits, sanctions, or reporting delays resulting from data inconsistencies or network connectivity issues between your terminal and the regulatory servers.
5. Payments, Subscriptions, and Cancellation
Our ordering process allows you to select a product and submit your billing details. A secure payment link will be sent to the email address provided. The activation of licenses or onset of services will occur only after payment confirmation.
- Subscriptions: Recurring monthly plans (such as Elox Mail options) automatically renew unless cancelled before the billing cycle ends.
- Refunds: Due to the digital nature of immediate licensing and custom work, refunds are subject to evaluation under commercial policies and applicable consumer protection laws, excluding setups already executed or custom labor already performed.
6. Intellectual Property
All software codes, designs, interfaces, documentation, logos, trademarks, and content displayed on this website (including Elox Farma, Elox SNGPC, Elox Trader, Elox COPY NT8, Elox Mail, Site Institucional, and Consultoria) are the intellectual property of Elox Digital or our licensors. You are not granted any rights to our brand assets or proprietary source code except for the specific license terms purchased.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Elox Digital and its representatives shall not be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, loss of profits, loss of data, business interruption, or trading losses) arising in any way out of the use or inability to use our software or services, even if advised of the possibility of such damage.
8. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Portugal. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Lisbon, Portugal.
